How long can the police hold a suspect? Could he get bail even with my positive ID and DNA evidence against him?

My rapist was arrested today. I want to know if he's there for good. I don't know if there will have to be a trial and everything even with my statement, ID in a lineup, and DNA evidence from a rape kit.

This depends upon many things. A person has a right to bail in almost every case, because they are innocent until proven guilty. Depending upon the circumstances, the bail may be so high that he will sit until trial. It depends upon numerous factors.

The suspect will go in front of a judge for his bond setting but this does not mean a bond will be given to him (it could be denied), it depends on the circumstances. If he is released from jail, the Charleston County Detention Center will typicaly call the victim involved and let them know of the release. Your case wil be assigned to an Asst. Solicitor for prosecution and you should contact the Solicitors office to find out who that person is and meet w/them shortly so you know what is going on w/the case.
