What damages can Safeway seek for refusal to pay settlement demand for shoplifting meat to Palmer, Reifler & Associates, P.A.?

Firstly, this was a huge error in judgement and will never be repeated as a result of this incident with store security. The merchandise was recovered in resellable condition and restocked. No injuries or property damage occurred. No police report was made. Value of meat was $8.00. Law firm demands $300. How can a company like Safeway take one to court for $8.00 worth of cheese unlawfully removed from the store when it was recovered, restocked and likely sold, much less demand $300 restitution?

It probably won't press the claim over $800. These kinds of demand letters are becoming a regular part of the questions asked on this site. The consensus is that it is highly unlikely that the business will actually pay an attorney to collect these kinds of claims. It is possible you could be sued. It is up to you to decide if you want to call their bluff or not. Good luck to you.

The civil demand letter alone does not create an independent oblgation to pay if it is not followed by a civil lawsuit, which almost never happens.

In the last five years I’ve never seen a person in your situation who has received the letter actually being taken to court on collection. It’s not economically feasible for the company to act in this matter. It is statistically most improbable for this to happen.
