He wants the documents.

My brother insists that he wants the signed/notarized quit claim documents to the properties that he is quit claiming to me. He claims he will mail them to the Recorder office. I say since the properties are going to me, I should be the one to mail them. Your opinion(s) please. Note: he behaved badly during the Estate proceeding when I was the Executor of the Estate.

This is a family matter, not a legal question. With that said, typically an escrow does this work. However, in your case if you are worried about your brother you as the grantee should do the recording.

I agree with the above counsel. Your problem sounds more like one of being able to trust your brother, rather than one related to the proper procedure at the Recorder's office. In any event, normally the deeds will not be accepted for recording without a form entitled Preliminary Change of Ownership Report (PCOR) signed by the grantee. In this situation, you would be the grantee and your signature would be required on the form. So, normally, your brother would not be able to record the deeds unless you already signed the PCOR form to go with it. Brad C. Brereton BreretonLawOffice.com 831-429-6391
