I co-signed for a car loan for a friends fiance over 4 years ago. My name is listed first on the loan. 1 she has been late and/ or has not paid. Also She was arrested last night for battery on myself, and domestic battery on him. Do I have the right to take the car and use it for a trade in. Or because she has been the one making payments do i not have that right? Please help. When she gets released, i am affraid she will either stop making payments, and/ or disappear with the car. and I will be left responsable and my good credit will be ruined.

The key here is not whether you are a co-signor but whether you are on the title. If you are the owner of the vehicle then you have the right to take possession. There are other factors to consider and would recommend that you consult a civil litigation attorney to determine if you should file a law suit.
