Is it worth it to fight a tailgating ticket in court?

I was driving behind a police officer on a wet road, with recently replaced brakes that are now softer than I am used to. My "low traction" light was on in my car. Though I was using my brakes to try and keep pace and away from him, he still pulled me over, claiming I was tailgating. I've never been ticketed with tailgating before, and it certainly was not on purpose. Is it worth it to try and fight this? It's now going to put 5 points on my license and fees that I don't have the money to pay.

The prosecutor might offer you a 3-point or a 2-point plea bargain. It might not seem like a great deal, but you do not want a 5-point tailgating violation on your record. Bringing it down to 2 or 3 points may save you a lot on your insurance policy. I would also highly suggest hiring a local attorney to go to court with you.

You should absolutely plead not guilty to a 5 point offense. You cannot do any worse. I would recommend that you hire an attorney that regularly practices in that court and can negotiate with the prosecutor and speak with the officer to lower the penalty.

Yes, plead not guilty and hire an attorney. You might be able to get a "plea bargain" (aka "plea agreement") that reduces the charge to a two-point violation - or while rare, a no-point violation.

This is a 5 point ticket. It will likely raise you insurance premiums. You likely can get this reduced under 5 on your own but an experienced criminal defense attorney may be able to get it to 2 (very likely) or even 0 points. Call your insurance company, my guess is it may be a $500/year increase. A attorney will cost more up front but a lot less over time.
