I want to cancel a home service contract with pest control company.

We have a 2-year service agreement with a pest control company that started in May-June, 2012. They come to the house quarterly and we pay them for bug, pest, control. After the initial service we had them return twice since we still had bugs (i.e., ants and spiders). We had them come again and it slowed. However, we started seeing them again and they came a third time. We decided to cancel the service but now they are requesting a 60% cancellation charge for the remaining two years. We did initial fine print on the document.
However, we have not been satisfied with with their service and this is the basis of the cancellation and refuse to pay the cancellation fee.
Do we have to pay the cancellation fee since we were never satisfied with their service?
In court, the issue would be what guarnatee was provided. If all they said is that they would return as many times as you want, but there was no promise of a pest free home, then you are stuck since they are meeting their end of the bargain.
I agree with my colleague. These matters largely depend on the service agreement language. However, the company will argue that they have met their burden. It would be best to have an attorney analyze the "fine print" of the agreement.
You might want to consider bringing your service agreement to an attorney for legal review. That document controls the nature of your relationship and most likely includes termination/cancellation language.
Good luck to you!
