Anonymous6 views6 answers
I was going about 50 mph when i saw a car make an ilegal u-turn at the intersection i was approaching, tried to stop slid 56 ft into the drunk driver w open cans of alchohol in his car, my car is totaled.he was arrested, and he as well as the witnesses on the police report explained what happened and he is 100 percent at fault, i hit my head and have waited a week thinking the back pain would go away but it hasnt im going the hospital tomorrow. Just wondering if i should go down the route of suing?
Clearly you are not at fault and you are injured. At the very least, you should speak with a personal injury attorney to explore your options. Whether or not you will be able to sue will depend on the type of insurance policy YOU carry and/or on the type and nature of your injuries. I would be more than happy to discuss your case with you. www.GhabourLaw.com or call me at 732-967-9110.

You have the right to make a claim against the other individual for past and future medical expenses, lost income and pain and suffering caused by the collision. The first question is whether the drunk driver was insured or not. If not, you have to think about the probability of getting paid before you sue. If he/she is insured, you can start by making a claim. If the insurance company does not make a reasonable settlement offer, then you can proceed with a lawsuit.
Whether you are injured enough to make a claim or sue is really your decision in the first place. If so, you should consult with a good New Jersey personal injury attorney about your rights.
Good luck.

You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statement to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights. You may also find it helpful to review the Legal Guides I have published on .com dealing with many of the issues you are now facing.
