It has been almost 30 years since DWI was eligible for deferred adjudication.
Sometimes, we see small town prosecutors who try to give it.
But, I must tell you that I practice in Brownwood on a regular basis, and County Attorney Britton and Assistant Courty Attorney Bird both are well aware of that the law does not permit deferred on a DWI.
What you need to do is get a reputable criminal defense lawyer.
The best way to keep a DWI off your record is to get a quality attorney and be prepared to fight the charges. Like the other attorneys stated deferred adjudication has not been an option since 1984.

Deferred is not available for a DWI charge. You need to get a good attorney. If the case is weak, you may get an offer of obstructing the roadway. It is also a class B misd. Sometimes I am able to get this where there is not a breath test or blood sample. If course, if you were not over the limit you should fight the charge. If you were over the legal limit, your attorney should attack the evidence and get the best offer possible. Good luck.
