What is the Nonimmigrant Information System (NIIS)? My FOIA request retrieved this document with my lawful admission information

My passport is lost. Attempts to retrieve replacement I-94 via I-102 have been unsuccessful with the DHS/USCIS writing to me that they have no record of my lawful admission in 1996. But I remember coming from Russia through Anchorage International Airport in 1996 when I was 8. I sent a Freedom of Information Act request in December 2011, and just got a response by mail on Saturday 10/6/12. There was 1 document which stuck out among 80 pages- it was a Nonimmigrant Information System printout. It detailed my arrival number, passport number, visa issue post, visa issue date, arrival date and inspecting officer. My immigration attorney said he had never seen anything like it, and he said he would "get back to me" as to how we can file our I-485 using this document as proof of legal admission.

Yes, I've seen that print-out and I have used it to file an I-102. Although you could try filing the I-485 with just the print-out ... I'd be more comfortable with a replacement I-94. As for keeping your attorney ... you must balance out cost vs. experience. It will be very difficult to find a highly experienced attorney that is low-cost. Good luck.

I agree with Mr. Capriotti! There are other ways to prove legal admission, but it is always easier to prove it with an I-94.

I agree with Mr. Capriotti that filing an I-102 for a replacement I-94 should avoid problems, but I have also used this type of NIIS printout before to prove entry information. This is a decision you have to make in concert with your attorney. As to your attorney, remember that choosing to retain an attorney, as well as which attorney you choose, is up to you. You need to feel as confortable with your lawyer as you would with your medical doctor; one deals with your legal ills, while the other treats your physical ones. If you are not comfortable with your current lawyer, you should consider retaining other counsel. Good luck!
