Can my husband go to jail if he got credit cards in our our chuildrens names and used them?

My husband who is disabled obtained credit cards in our biological daughters names and my two children from a previous marriage names. He used them to buy items for the children, clothing etc. and to pay b ills. He did this during a period of time where there was no income into the home. He was waiting on a desicion from social security. I am also disabled and was unable to pay the bills with my checks. He was unable to make payment on the cards and no body knew anything about the cards until my xhusband looked into my other childrens credit records. I did not file charges against him for the cards in our bioloigicals daughters name and as far as i know my x did not file charges on the other cards either, but yet my husband got a letter to appear for arraingment.
