L2 Visa extension.

Me and my wife were convicted for shoplifting case. But I have got my L1-B approved very recently in premium process. But my Company refused to apply for L2 since I-539 specifically asks for past criminal activity and I have to apply by my own. I will apply for my wife's L2 soon. My Questions are : 1. since my L1-B got approved, will L2 will also get approved? and 2. how much time will it take to process L2? As I know there is no premium service for L2 processing. What is the normal processing time of L2 visa? 3. Is there any chance of deniel of wife's L2 visa? 4. Do I need to hire any attorney for processing the L2 visa? If yes, what will be the role of the attorney in the process?

1. Your approval does not guarantee her approval. 2. I have been seeing these applications take a little as 30 days and as much as 4 months. 3. Yes, there is a chance of denial if you do not adequately explain the conviction. 4. I think that you should at least consult with an attorney. They can help you to deal with the conviction.

With any criminal issue, we always suggest talking to an immigration attorney who understands the consequences of crimes. Too much is at stake.

1. Each application is adjudicated on its own merits. The fact that yours got approved is not a guarantee that your wife's will be as well. 2. Will take months. Look at the processing time reports on the USCIS website and add another 33%. I say it'll take at least 4 months. 3. Yes, unless this misdemeanor conviction is properly explained by an experienced immigration lawyer. You need to attach the court's FINAL CASE DISPOSITION DOCUMENT and NOT the entire arrest, police report and what ensued in court, with all the gory details.. ALL YOU NEED IS A COPY OF THE DOCUMENT I HAVE MENTIONED ABOVE. Go to the court's clerk office to request it. It needs to be ONE PAGE, no more! (You don't want the clerk simply printing out the whole case history and just handing it to you.. THE FINAL DISPO DOCUMENT IS ALL YOU WANT, NEED. Ask to speak to a supervisor there. 4. You bet. The role of the attorney will be, among others, to draft a MEMORANDUM OF LAW to the USCIS explaining why (with Regulations and case law citations) one single instance of petty theft conviction does not render your wife inadmissible, etc. Best of luck!
