Stale/expired affidavit in Michigan

Attached to the summons and complaint is an affidavit from the junk buyer not the attorney and it was written 15 days before the summons was filed. Can I have the affidavit dismissed for being stale or older than 10 days in Michigan? Should I put that in my response to the summons?

I have never heard of an affidavit going stale in 10 days, 15 days or even 1000 days. What are you trying to accomplish?

I agree with my fellow respected attorney and nor have I heard of a stale affidavit. At least they have given you the affidavit of what one person is expected to say and pinned down part of that testimony which is the disclosure requirement anyway.
