Landlord and I agreed to terminate agreement; still haven't received security deposit from landlord. What should I do?

Rented a home with a major roach infestation. Landlord agreed to void agreement and return $1400 security deposit in 60 days. It has now been 6 months and the Landlord has recently begun dodging calls and messages. Lease stated that if we were to go to small claims court we would not be entitled to sue for Court costs. However, if agreement was voided does this go out of the window? I have emails and text messages reflecting Landlord terminating lease and promising to return security deposit. What are my rights and next steps?

Was the agreement reduced to writing and signed by all parties? If no, then you may have an issue proving the agreement in court, however, if you have admissions by the landlord as to the agreement, then this may suffice. I would have an attorney contact them in writing via a demand letter. If this is not successful, then you will have to consider small claims. www.IrvingReillyLaw.com
