Does the Texas Civil Procedure allow for Motions to Enforce Temporary Orders?

I need to file a Motion to Enforce and order to pay fees. But the order is within a temporary order. Can I motion to enforce it? Contempt? I doubt that I can enforce because it is not a final order pursuant to the following: Sec. 157.001. MOTION FOR ENFORCEMENT. (a) A motion for enforcement as provided in this chapter may be filed to enforce a final order for conservatorship, child support, possession of or access to a child, or other provisions of a final order.

Temporary Orders are enforceable. The pleading and proof requirements are the same as for final orders. What type orders do you want to enforce by contempt? I will tell you that pleading and proof is very technical in these matters. I suggest you get an attorney to do it for you if you are serious about the enforcement. Different remedies are available for different types of orders. Don't try this on your own. You won't be successful.

It sounds like you are a non-lawyer trying to represent yourself in a divorce case. I am a lawyer, but I would never consider doing what you are trying to do because I lack the requisite knowledge and skill necessary to be able to do it correctly and be successful. My advice, therefore, is to hire a lawyer who knows how to handle this situation Otherwise, you are headed for certain frustration and perhaps worse. I suggest that you consult a Houston lawyer who is cetified in Family Law by the Texas Board of Legal Specialization. A link to the Board's website appears below. Good luck. www.tbls.org
