Who is at fault if someone with only a permit gets into an accident but had the right-of-way?
Anonymous3 views5 answers
I was driving through a roundabout with only a permit and no insurance on the car at the time and i had already started going when a guy coming from the right got in. Not having enough time to turn completely and avoiding the accident I hit his company truck leaving only a scratch on it, while my car's front had a been smashed in. Who is at fault and would his company pay to have my car fixed?
The general rule is that you must yield to the right, but, no one can determine who was at fault on this site. The facts must be carefully reviewed and you must look at the scene. You must also consider the other driver's side of the story.

The issue of a permit does not go to who is at fault. You should contact a local attorney and have them review the facts of your accident to help you determine fault.
Round a bouts are contributory negligence waiting to happen. Contact the carrier and the property adjuster of the insurance company. They will conduct an investigation as to determine fault and you may want to explain your side.
Permit = Learner's Permit? I assume you did not have a licensed driver in the car. If you did, you should have a good witness on your side.
You should have gotten tickets out of this but those do not directly relate to how you were driving or negligence.
Almost as important, though, is that without you having insurance, the company's insurance company may file an action with the Department of Transportation to suspend your license and the license of the car owner if different until their damages are paid. If they do this, you must ask for a hearing.
