Would we have a valid case against kaiser for possible malpractice or personal damages ?

My father has been a member of kaiser for about 15 years. In 1994 he was in a car accident that cause him to have major back surgery including a stainless steel rod placed in his back. After a year of its placement the rod broke in his back and has been there broken ever since. After that he has accumulated multiple health issues including diabetes, pulmonary artery disease, kidney failure, liver failure, strokes and moderate heart attacks. The doctors have done little to nothing to help him with his ailing health but to continue to perscribe a cocktail of pain killers and muscle relaxers to the point that almost have no effect on his pain. He is only 46 and feels on a daily basis like he 87 not to mention he has come to the point where he is so sick he is afraid he going to die soon.
Without examining his medical records no one could give you an answer. If you think he is not getting the proper medical care why not switch doctors? It seems like a fresh set of eyes is what your father needs right now.
Good luck.

Successful medical malpractice cases generally arise from a single identifiable incident, Your father has a whole lot of health conditions that will be impossible to attribute to any single cause. Therefore the chances of bringing a successful medical malpractice claim are probably very remote.
You need to consult with either a Kaiser surgeon or an outside surgeon to determine whether the rod should be surgically addressed. You also need to speak with a doctor to determine whether the various maladies your dad has are due to Kaiser's care or simply a consequence of other issues unrelated to his Kaiser care.
