If you hold Australian citizenship, then an employer could file for an E-3 work visa on your behalf. There are currently no H-1B visa numbers available until the beginning of the next fiscal year, which begins on October 1st, 2013. If you find an employer willing to petition you (and are NOT Australian citizen) then that employer can file on April 1, with a start date of Oct. 1, as explained. You can find an employer to sponsor you for a J-1 "training" visa, thru one of the innumerable organizations which sponsor that kind of visa. Try www.aila.org , for instance. The problem with this visa is that it will only be valid for a year or a year and a half and cannot be renewed. But it could bridge the H1B visa availability "gap" for you. There is also the H-3 Training visa. Very hard to put together & get approved. It needs a detailed "Training Plan" for the entire 1 year period the visa will be available and the 'training" needs to be of the kind which is not available in your country of nationality. I did quite a few of these, let me know if you need help. Can be renewed for only one more year. If your parents are becoming citizens soon, then either your mother or father should file an I-130 Petition on your behalf. It will take years to go thru, but much less than if one of your siblings would file on your behalf. Last, but not least, extremely important for you to schedule a consultation with an immigration lawyer in your neck of the woods, so that you can have expertly and individually analyzed all the options available to your and THEIR FEASIBILITY.

We have an offices here in Maryland and we have received your inquiry. In short, yes you can certainly change your status, but planning well in advance of your B2 visa expiring is essential. There are special visas for Australians and the standard H-1B visa is also an option. Have you received a job offer? We are able to assist in speaking with potential employers who want to hire you, but will only proceed once they are clear on the Immigration work visa process. Also, we can advise you on getting a credential evaluation which is essential for work visa options. Likewise, changing to a student visa requires that you have begun looking for schools who will enroll you and issue an essential form called an "I-20". Most of the major accredited schools in the area offer the I-20 for international students. You would then be able to change your status once you meet specific federal regulations and show you have no immigrant intent when applying for a student visa. You may contact our office to set up an appointment in our Maryland Office, and I would be happy to meet with you to discuss these options.
