HI, I was recently a Defendant in a Civil Case. I los the case and the Court ordered me to pay the Plaintiff $3k. I have appealed the case and it is currently pending with the division of appeals. I have already been given a due date for my Opening Brief. However, I recently received a "POST-JUDGMENT REQUEST FOR PRODUCTION OF DOCUMENTS" AND A "POST-JUDGMENT REQUEST FOR SPECIAL INTERROGATORIES". Most of the information requested is regarding my finances. My question is ... Do I have the right, or can I also submit Post judgment request for discovery to the other party?? and is the other party's post judgment request part of the appeal? or still part of the civil action? I would greatly appreaciate some information. Thank You.

Once a judgment is entered against you, it is collectable. The plaintiff can do whatever is legal to collect the $3,000 even if the appeal if moving forward. There are ways to stop that process, but if you have not done any of those things, the plaintiff can (and apparently will) proceed with collection. One way to collect is to do post-judgment discovery. This discovery seeks the status and whereabouts of your assets. Once they get that information they can devise a plan of attack to seize assets to pay the judgment. You do not have a right to post-judgment discovery because you lost and have nothing to collect. You need to either take action to get a stay of post-judgment collection efforts, or you need to answer the discovery. Good luck to you.
