Failure to make a complete stop at a red light before making right hand turn...How can I fight this?

2 views 3 answers
I had enough time to parallel park my vehicle, roll down my window and greet someone I knew who was walking by, turn my car off, gather my things and open my car door before this officer even pulled up shining his lights on my car. He approaches my vehicle and says I failed to make a complete stop and asks if I have any idea why I would do that. I tell him No, because I was sure that I did, in fact, stop at the light before turning. He asks where I was headed. I told him I had work. He looked at the time and says "Maybe youre running a little late?" and I said "I dont know I wasnt really looking at the time". I did make a stop at this light and I had a witness in the car with me who says I did also. Do I have any chance of winning this?

Your best chance of winning is hiring an attorney that specializes in traffic ticket matters. If you want to fight this yourself make sure you bring your witness to the trial and go in person. Robert Driessen

A trial by declaration is usually a good option. If you lose it, you can still file a trial de novo and have an in-person trial with a judge. You must post bail upfront though for a TBD. You esseentially have 2 chances to win your case. DO NOT incriminate yourself on your statement of facts in the TBD.
