Can anyone give me their HONEST opinion on my DUI and Reckless Driving Probation, it is regarding terminating or non-reporting?

I got a DUI at .085 and while waiting for court (w/ a hired lawyer) I got another DUI at .075. No other previous record. I am 23. I received the DUI (.085) and I got a Reckless Driving. They run concurrent. The DUI is 1 yr probation. The Reckless Driving is 3 years because: FTML (1 yr) and Driving with care (1 yr- I said i had my GPS on my fone) and reckless driving (1 yr). Total time to serve is 3 yrs. I just started in Aug 29, 2012. I just finished all class, community services, paying fines, paying ALL 3 yrs probation! It is in Gwinnett (Judge Doran, PO:Pole SE corrections). My PO said she would not be able to put me on non-reporting but try with a lawyer. My terms are to call in every month (I live in FL), come in every 6 months (expensive), random drug screens (i do it everytime).Help

Here is an HONEST answer. Don't know if you have been getting dishonest answers up until now or what. It is not perfectly clear what you are asking, but I gather that you are hoping to get your phone and mail reporting probation changed to non reporting. Judge Doran is very fair and very thoughtful in his sentencing. He consistently gives lighter sentences than the prosecutors recommend. He also considers probation to be a privilege and not a right. He likens probation to "early admission to heaven" in that the law authorizes him to sentence you to three years in jail but he gives you the benefit of the doubt by allowing you to serve your sentence on probation rather than sitting in a cell. Considering the fact that you got two alcohol related offenses in a very short period of time, just two years after your 21st birthday, the sentence you received does not surprise me. It is very unlikely that Judge Doran would consider amending your sentence until after you have served at least one full year on probation and more likely 18-24 months. You also need to be very sure that you complete all of your conditions and are very cooperative and respectful of your probation officer, as Judge Doran takes these things very seriously.

Here's an HONEST answer for you: STOP WHINING! The court has already accommodated your needs and will not be sympathetic toward your complaint of it being difficult to report in person once every 6 months. Everyone else is reporting in person to probation every month. The judge gave you a lengthy probation sentence because the judge wants you supervised for that time; you already have two alcohol related traffic violations within a short period of time. Not having to report at all would defeat one of the main purposes of your probation (to monitor your conduct). If you were to go into court now with the attitude that reporting by phone once a month and in person every 6 months is too hard, the judge is going to be furious with you. Probation is not supposed to be easy, but it sure is a lot better than being in jail for three years. If you want to try to get your sentence early terminated (or your probation put on non-reporting), you better change your attitude. The judge is not going to care that reporting in person is expensive, calling is a hassle and the random drug screens occurr everytime you report. What he might reward is the fact that you have completed your other conditions, but you are going to have to be monitored for more time than just a few months before he is going to change anything.

Having known Judge Doran for many years before he was a Judge, I agree completely with Mr. Proctor's assessment of him and his motivations for sentencing you to what he did. Get at least 1/2 way through your sentence and then look into amending it, but only if you have had not so much as a speeding ticket in the meantime.
