I have copies of reciepts and copies of the estate being closed and the form used to closed is a legal document it is "A Sworen Statement Of Personal Representative Closing A Small Estate" that she signed and noterised and filed in Renville County by her # 3 say "I ave fully administered the estate by disbursing and distributting it to the persons entitled thereto." What does this mean? She thinks that it means that she sent all the document to us. Is she correct? And I think the only way it is even near correct is that she kept all the flow of income uptil the date on the form to pay her back. I have an itemized list/statement of money she spent throughout the years and the one she filed says she is still owed $550.00 and if you diviede by6 there are 6 heirs =$91.66/each 5+her=6 heirs.
Given the circumstances, your best bet is to immediately consult a competent Colorado Estate Planning Attorney (look on .com under Find-A-Lawyer). I believe you need some guidance here. Good Luck !!
I agree with Attorney Potter. Your summary is confusing and complicated. The form that you mentioned means that she is telling the court that everything has been distributed to the beneficiaries and that the estate is ready to be closed. It is unclear if that was actually the truth of the situation. Giving her the benefit of the doubt, it is possible that she has simply been withholding rent payments until she is fully reimbursed for her expenses. The problem with that scenario is that, if the estate is truly closed, then she has no more authority over those assets than *I* do. I think you may need to have an attorney look this over to make sure that everything was handled properly.

Both attorneys offer sound advice. If the estate is closed then it means that it no longer has any assets. If this is not the case, then you have a problem. Get with an estate litigation attorney immediately to discuss your options.
