How far away from a residential property can a LIVESTOCK ANIMAL shelter be? Are there "set backs" for sanitation in AG areas?

We just finished a very pretty vinyl sided and landscaped guest cottage on our 32 acre farm. The NEIGHBORS who do not like us, waited until completion. ( septic, 400 ft well, power etc - that cost us a small fortune to do ! ) Now they dragged over some HUGE telephone poles, and scrap metal, basically Right ON the property line (or very very close) to build a "run in livestock shelter" for goats /horses. Not only does it obscure the view, but I am thinking the smell of manure etc, and the fact that it is approx 28ft off the living room window of the cottage - that it is being done totally for spite (they dont like us) .. they waited until the cottage was COMPLETE to decide WHERE to put their livestock shed, they have 87 ACRES, & they placed it 28ft away,Not built YET- but they started!

Set-backs and zoning are specific to each jurisdiction. Contact the zoning & planning dept of your town/county (depending on where you live) to see if the neighbor is compliant. You could also hire a local attorney to research the issue... Good Luck. Mike

I agree with my colleague - call your local zoning office. If they are within code, the shelter can stay regardless of what you think their reasons are for placing it there.

If odors or other aspects of the neighbors' shelter unreasonably interfere with the use and enjoyment of your property and cause you substantial harm, you may have a private nuisance claim. I suggest talking with a local attorney who has experience in land use issues.

If you cannot establish a zoning violation, you could potentially file a civil suit for nuisance. I would consider contacting a local civil litigation attorney.
