Do I need a lawyer for late traffic and parking tickets?
Anonymous2 views1 answers
I have a parking ticket and speeding ticket in DC. I live in Florida and neglected to pay them. They are several months past due. If I pay them, will it affect my driving record now that they are delinquent?
I have a clean driving record for 15 years but exercised poor judgement on not paying these. I was in the process of moving back to Florida at the time. Thank you for your help.
Payment of parking tickets will have no effect anywhere on your license; but nonpayment will entitle the District of Columbia to seize and impound your vehicle if they ever find it within the confines of DC (which seems unlikely now that you are in Florida). Payment of a speeding ticket will result in a conviction for that offense, plus points assessed against your DC privilege to drive, but not likely enough points to result in a suspension (unless you were driving at a speed qualifying as reckless driving). Nonpayment of a moving violation, on the other hand, will result in DC suspending your privilege to drive in DC. In that event, Florida will likewise suspend your Florida license (or whatever state has issued you your current license) in reciprocity under the Interstate Compact Agreement. So, in reality, you MUST deal with the DC ticket in order to lift that suspension. Paying it is the easiest way. Getting charged with driving while suspended is a jailable offense. I do not know how Florida treats an out-of -state traffic conviction, whether it reports those on your FL license, or whether it also assigns points against your FL privilege. For instance, if you had a Maryland license, Maryland would show the conviction, but would not impose points or consider the violation in connection with any contemplated suspension based upon accumulation of points. If you had a Virginia license, on the other hand, Virginia actually imposes the number of "demerits" it would have imposed had you been cited and convicted on that same offense in Virginia. Therefore, to know what the impact will be in Florida, you need the advice of a FL lawyer.
