Evicted in Orlando, FL with a 24 hours notice, never received any other notice

My rent had been late several time due to employment issues. My rent in October was paid on the 10th of the month and is due on the 5th. This was not the first time it was late. The property manager decided to not cash the payment in the for of a money order and never informed me of this. When I checked into the status of the money order a week later I found out it had not been cashed. The property manager told me they never received it. After speaking with them they then told me they found the money order and would see if the owner would accept it. I did not hear back from until I received a notice on my door telling me I had 24 hours to vacate. They claim they put a notice on my door sooner then that but it was never there when I returned home from work. What are my options !

I am assuming that this is not a Writ of Possession. If it was, see an attorney immediately. If this is just a notice from the management company and not a case that was filed in the courts: Pay your rent on or before November 5th. If you had already paid the October rent and management has it and refused to deposit it, you probably should hire an attorney to ask them why they didn't deposit the money order and let them know they can't refuse it. The only way they could refuse it is if they served a three day notice and you ignored it. After the three day notice expires, they can refuse the money and just sue you for it. If you have a voice mail message or email from the manager saying they found the money order, be sure to keep it! The attorney should ask to have a copy of all three day notices aka Pay or Quit Notices that were served in the last 90 days to see if they really did serve you a notice before you paid on October 10th. (in order to be able to refuse the money order, the notice would have had to expire on or before the 10th, which is impossible, bc if they served you a pay or quit on the 6th, it would have expired on the 10th, which is the day you gave them the money order.) I think you need to hire an attorney to stop them from lying. Also, they need to be stopped from putting 24 hours' notice on doors, which is an illegal scare tactic. (unless this is actually a Writ of Possession). Good luck.
