I lived with my father for 35 years in his home. He died without a signed will and now my sister wants as much as she can get at any cost. She claims I own nothing inside the house, but obviously, I have obtained things over these 35 years. What are my rights since it has been my residence all my life? How do I protect my things?

One of the things you can do is to have the court appoint YOU as the administrator of the estate. That would put YOU in charge of handling things, and would prevent your sister from controlling the administration of the estate. The other thing you can do, regardless of who the administrator is, is to retain an attorney to protect your interests. I am very sorry for your loss and your ongoing situation with your sister. Hopefully, she will be a little less aggressive as matters progress. James Frederick

Mr. Frederick is correct. At this point, whether you or your sister are appointed administrator of the estate, you need counsel for yourself. As administrator, you or your sister may retain counsel for the estate, but you need to understand that you and the estate are different and you have different interests. You need your own lawyer for guidance.

Both attorney's answers are correct. To add to their response I recommend that, provided you can qualify, you petition the Court to become Administrator. Normally administrators are entitled to fees and it places you in the position of decision maker and not decision follower. However, your duty of loyalty shall be to the beneficiaries.
