How can I get my husband to leave my house now?

Business 2 views 3 answers
I have owned my house for 17 years. I got married 5 years ago. I never put my husbands name on the deed. Now I want a divorce and he is very angry. I told him he could stay until he finds a place, but he is making my life hell. He is putting me through such mental abuse. Constantly pushing my buttons and doing things to purposely make me mad. How can I get him out of the house now?

While the house may very well be yours, as it was and continues to be the "marital residence" you do not have a right to kick him out. Therefore, absent an Order from the court he will not be required to vacate. If he is truly abusing you, you may be able to have him removed by securing a Restraining Order via the Prevention of Domestic Violence Act. To explore that issue in greater detail you may benefit from consulting with an experienced family law attorney in your area. Kenneth A. White, Esq. New Jersey Divorce Attorney 732-819-9100

You can file a motion to have him removed from the home. Also if he is harassing you, you might want to seek a restraining order under the Prevention of Domestic Violence Act.

If there is grounds for a Temporary Restraining Order he can be removed from the house. Regardless you need to contact a Family Law Attorney and get the process started so this can come to an end as quickly as possible.
