How to do i get my California drivers licence back after a DUI?
Anonymous3 views3 answers
This is my only DUI. I paid all the fines. I compleated all the classes and counseling sessions. I dont own a car. I was driving my brothers car and using his extra car to get back and forth to work. Sometimes I borrow my gilfriends car for work. DMV wont give me my licence without a breath ignition on a car. I dont own a car. I really just need to get back and forth to work. Is there any way i can get a licence to get to and from work without having to install the breath ignition witch i really cant afford. I really dont want to get caught driving without a licence but really need to get to and from work. I dont have money for an attorney or to get a breath ignition. Any advice would be apriciated.
The law allows you to request an exemption from IID installation. The Exemption for Ignition Interlock Device (IID) (DL 4055B) form is included as an insert with all DUI suspension or revocation notices mailed to offenders in the pilot counties. The form must be submitted to a DMV field office or mailed to the Driver Licensing Mandatory Actions Unit (DLMAU) within 30 days of the suspension or revocation notice mail date.

Although you may be able to get an exemption, and get a license back, you will not be able to drive a personal car (such as your girlfriend's car) without an IID. If you get caught you will be in a lot of trouble. If you can't comply with the law be prepared to pay the price. And the IID providers will work with you on payments.
If I read you right, this is a first offense DUI carrying a 6 month suspension (plus concurrent 4 month APS .08% suspension) for grand total of 6 months (unless BAC .20% then it would be 10 months) Whew!! So if you've been arrested, been to court, finished your DUI classes, you must be close to finishing up the 6 months suspension anyway.
Just get proof of insurance (non-owner) SR-22 from any insurance company and about $150 and head down to the DMV. The IID installation was a way for you to drive during the suspension period... just because you don't own a car and didn't install an IID doesn't mean that you are thereby suspended for the rest of your life or until you do buy a car and install the device... though the IID folks might like that idea! (Follow the advice previously given about non-ownership of a vehicle) My county is not one of the Pilot IID counties requiring installation so others may have more information.
