I was falsely accused by police of hitting a bike that I did not hit. I now have a court summons. How do I defend myself?

I pulled into a parking spot with a bike that was laying on its side at the end of the spot. The bike was not in the spot it was in the grass. The spot was free and it was the last one so I took it. Another spot became available right after I parked so I moved my car to the new spot trying to avoid being accused of hitting the bike. The police report says that an officer witnessed me hit the bike. This is a lie I did not hit the bike and it is also a lie. I now have a court summons but I can't get acess to the survailnce video without a lawyer. Do I have to get a lawyer? How can I sue for this fasle accusation and the costs and trouble that I am going through. How do I prove innocent in court? Will my insurance go up?

The first thing you need to do is retain a lawyer as soon as practical. There are deadlines in any lawsuit that if missed, can cause you to lose and possibly have no further remedy. You don't explain if the summons if for a civil case ($ damages) or a criminal case so it is difficult to continue to provide you some useful information. However, if it is a criminal or traffic ticket matter, contact a criminal defense lawyer or lawyer who handles traffic tickets in your area. If the case is about the damages to the bicycle, you may want to contact your insurance company so that they can retain a lawyer for you.
Either way, a trial is designed for the witnesses to provide sworn testimony regarding the situation and for a jury or judge to determine the credibility of the witnesses and make a decision as to fault or guilt. I strongly recommend that regardless of the type of case you have, that you consult with an attorney in the Baltimore area soon so as not to jeopardize your legal rights.
Q: How do I defend myself.
A: non-attorneys lose cases against attorneys 99.9999999999999999999% of the time. How do you defend yourself? Get an attorney. If you cant afford one then one will be appointed to you. Let your insurance company know of the accident. Good luck.
