I am a Nigerian on asylum status in the US. I have a permanent resident card. I plan to visit Nigeria this December.

Does my visit to Nigeria affect my status in the US? I claimed persecution from the Nigerian government. Can I visit Nigeria without getting into problems with ICE?

Traveling to a country from which you claimed persecution (as a permanent resident) isn't advisable as it may bring into question the validity of you underlying asylum claim. I'd suggest waiting until you naturalize.

Visiting Nigeria will call the validity of your asylum application into question, and could lead to your deportation. I agree with my colleagues. Travelling to Nigeria when you claimed persecution from there is TOO RISKY for my blood, if not down right STUPID.

As a lawful permanent resident you can travel outside the U.S. However, you should be conscious of your return to NIgeria if that is where you claimed persecution from. While travel to the country is not prohibited by law, the fact that you return there may cause DHS to review your application to determine whether it was obtained by fraud. The fact that Nigeria is a high fraud country makes the likelihood of this happening a distinct possibility/ ----------- Jeffrey A. Devore, Esq.
