Where does the courts liability come in to play?

was arrested on july 15 for dwi. upon arrest blood was drawn and both thc and alcohol were present. did NOT refuse breath test, merely the mode they chose to proceed with. almost three months after my release i was brought back in and placed under stipulations of bond.. now being held to strenuous standerds including, breath unit in car, drug test each month(though oddly there is not a section for alcohol on said test), as well as fees accosiated with breath unit and probationer. no accountability was taken by anyone in county for the confusion and i feel that it is not just for me to have dot every I and cross every T when the county cannot even keep up with who is in their system.. ami wrong in this?? please advise. thank you.

At this point, an attorney should have been appointed to represent you. You should address your concerns with your attorney, whose job it is to advocate on your behalf. If you dont yet have an attorney, you need to contact an experienced DWI attorney immediately; most will offer free initial consultations. It sounds as if as a condition of bond, the court wants to know that you are not driving drunk. It may be that in order to stay on release, you do have to cross every "t" and dot every "i." The alternative may be sitting in jail until your matter is resolved. Ask your lawyer if some of the conditions of release can be lessened, if you have been without any violations since being released.

You should take all these questions to your criminal defense lawyer. Generally, judges have wide latitude to set conditions of bond. The ones you list are not unheard of. If you do not have a criminal defense lawyer, the time to hire one is now. If you cannot afford one, you need to request one as soon as you get the chance.
