"Public intoxication, age 20, wasn't drinking in the bar but got pulled out"

I drank a few in my own home before going to the bar, apparently someone called me in although I was sitting quietly talking to friends minding my own business. He asked for ID, I went to the car to get it, he took me to his car and arrested me after I did a breathalyzer (blew a .10) Got out after an hour and got a notice to appear in court. Can I get out of this? No criminal past, would it be better to get underage drinking? No clue how any of this works.

If you have no defense to the charge of public intoxication and enter a plea of guilty, then the conviction the can be expunged from your adult criminal record if you have no additional serious violations within a period of two years. You would not necessarily have to use a deferred judgment to accomplish that. Maybe you have a defense to public intoxication because you were not intoxicated in a public place. However, it sounds as if the officer may have sufficient grounds for a charge of possession of alcohol under legal age (PAULA). I believe that is capable of being expunged from your record as well. You should speak with a local attorney who specializes in criminal defense regarding this charge. Be sure to appear in court on the day you were ordered otherwise a warrant for your arrest will be issued.
