Public defender compared to lawyer

4 views 4 answers
In all honesty is it better to go with a lawyer that you pay a high amount or a public defender? Not everyone can afford a lawyer let alone a high priced one, but the saying is you get what you pay for. So I am taking that what they mean by that is the more you pay the better the lawyer works to help you, so if I can't afford a lawyer I'm guilty no matter what. I don't believe that the courts see it as your innocent until proven guilty, I think it is more like guilty until proven innocent.

A public defender is an attorney and it is very disrespectful to assert that they are otherwise. However, they are often so overworked that a private attorney is more likely able to spend more time focusing on you case and getting you good results. I would always recommend getting a private attorney-but do not walk away thinking PDs are not real attorneys, because they are.

In follow up to Mr. Doyle's reply, you should appreciate that Public Defenders are often the most familiar with the Judges who might preside over your case and the prosecutors who will try them. They also represent a select group of public servants dedicated exclusively to the protection and defense of individual rights in the criminal justice system. Some of the most respected defense attorneys that I know as a former prosecutor and private defense attorneys are PD's. If you cannot afford private counsel, seek the services of a PD and take responsibility for asking all of the appropriate questions concerning the nature of your charges, the potential penalties, whether legal defenses to the charges exist, and what potential plea options are available. Even if assigned a PD based on financial need, you are still entitled to be satisfied with the services of your counsel. Indeed, if you ultimately intend to enter some plea agreement, the Court will specifically inquire whether you have done so freely, knowingly and voluntarily. If for any reason you do not believe your PD has answered all your questions or provided you competent representation, you're certainly entitled either to discharge your PD or ask the court for the appointment of another.

The Maryland Public defenders office is made up of highly skilled and dedicated professionals. However, like many government resources, there are few and the work is overwhelming. You cannot choose the public defender that will represent you, and most times those attorneys will change from court appearance to court appearance. Entertaining private counsel, you were able to choose the attorney that you wish to represent you. And private counsel usually has more time to give your case more attention. Well, to even have the option of being represented by a Public Defender, one has to qualify financially. This means that you have to demonstrate you are of very limited means to be eligible for a Public Defender. If you do face this choice, however, I would recommend retaining a private attorney that you feel comfortable about. This means you must try to gauge his or her attitude, competence, knowledge, experience, and compassion. With the Office of the Public Defender, you would get assigned an attorney, so you would not be able to select the best attorney for you. These situation could have dire impacts on one's life, future, and the lives of his or her family; thus, it is crucial to find the best attorney possible. Good Luck.
