Getting Rid of golds gym contract
Anonymous6 views2 answers
hello sir,
My name is Vijaya Bhasker Reddy Chirra. I myself and my wife are members of golds gym( Mooresville) since august 2011. we have signed a contract for 2 years to use services of gym at a monthly rate of 23.00 and together both it is around 50.00. since members we are unable to utilise there service as we have no time to go due to our busy work schedules. we are unable to pay there huge billings and also unable to cancel the contract cause only if we are moving permanently out this city to another state then we can cancel. i need a suggestion to how to get rid of this golds gym billing.
Based on what you describe, you are bound to the contract. If you fail to pay they can sue you in small claims for the breach of contract, and they can negatively report the non-payment to credit reporting agencies. You either pay, or hope they just let you go...but I wouldn't want to have to rely on that.
I suspect that Attorney Gorenflo's response is correct. You *may* be able to speak with someone higher up the food chain at the company, to see if there is a basis for letting you out. You have 9 months left on your contract, which is about $450. There is not enough money involved to go to court, for you. I suspect the same thing *might* be true for Gold's. They are in the gym business, not the lawsuit business. They are not going to prosper in business by suing their customers. So it may be the case that even if they do not agree to cancel this, that they will not chase you in court for it. Or they may decide to file a small claims action. You need to decide if it is worth the $450 risk. You might also decide that you are simply going to find a way to make the time to use the gym. It IS good for you. The payments are pretty reasonable, as well.
