I need a trust, because my husband died and he had gambling debts. He had 2 different social security numbers

Does an Ultra Trust the solution for me? one of his social security # was when he was born and the other was for the banks to obtain credit. The problem is i am a permanent resident, but i want to go back to Canada (Quenec) and it is not common law but the civil code. All the money is in mutual funds and i also have an annuity. If i go back, can the creditors get to the money. If i stay here, can the creditors get to the money and my annuity?

You have not given us enough information to give you much guidance. Where your husbands assets held jointly with you, or did they designate you as the beneficiary? If so, you may not be subject to the creditor claims. If the assets were in your husband's name alone and they pass through his probate estate, then the creditors can file a claim against that. Since your husband is deceased, there is nothing that you can now set up to avoid his creditors. You are stuck with whatever estate plan he had. You probably should consult with a probate attorney to help you sort this out. The two social security numbers make this even wackier than it otherwise would be. James Frederick

Sorry to hear about the loss of your husband. You defiantly need to talk with a local probate attorney to try and help you sort this mess out. Good luck.

Given that your husband has already passed away, there isn't much you can do to change the nature of his estate. You should consult with a local probate attorney that can go through all of your specific details to formulate a plan. at the same time, I would suggest that you draft an estate plan for your self. Good luck.
