Family Law/Custody

Child Custody 2 views 3 answers
I currently live in Spring Hill, FL and have been served to appear in court in Dakota County, MN regarding child custody. I currently have sole custody of my daughter. Since the court date has now been changed to after I have been here for 6 mos, can the venue be changed to FL or do I need a MN lawyer? Been trying to find a FL lawyer able to practice in both states. The court date is supposed to be 27 Nov but I have to hire a lawyer and have the date moved. He is a dangerous person (3 domestic sentences/1 child endangerment/1 child endangerment charge. Last DA occurred 2007- 3 yrs probation. Has a B&E, and was teaching our daughter racism and anti-goverment theory, involving her in rallies and she shows up on youtube in many of his videos. Where do I begin to keep her away from him?

You will need a Minnesota lawyer who can file an action challenging the jurisdiction in Minnesota and, in the alternative, seeking to transfer the case based on forum Non-Conviens. For a consultation call 612.240.8005.

No, the fact that you will have been in Florida for 6 months does not allow you to transfer jurisdiction over the case to Florida. You will need a Minnesota attorney to represent you. That said, if you are successful in obtaining primary physical custody, you may be able to convince the Minnesota court to transfer jurisdiction to Florida for future issues, based on the argument that Minnesota has become an "inconvenient forum."
