How Should I Plea to Obstruction of Justice Charge?

3 views 5 answers
What can I do to help my husband with an (unfair) obstruction of justice? Police arrived at my house because of a verbal altercation between family members staying with us (married couple). I believe a neighbor called. In attempt to diffuse situation, my husband answered the door and told officer that everything would be okay. Not sure what all was said, but officer accused my husband of 'bowing' up at him (which is extremely questionable). He threw him to ground and arrested him for obstruction of justice. What should my husband do? He is currently in a detention center. It's only been a couple hours. He is an honest and honorable guy. Will he have a record? What should he plea? This seems very unfair. Does he need a lawyer?

Even if the obstruction of justice seems unfair, I would highly suggest hiring an attorney as soon as possible and entering a plea of not guilty. If he enters a plea of not guilty, it protects all his constitutional rights while giving his attorney a chance to investigate the case and explore any possible defenses. If he enters a guilty plea, he will be sentenced and the case is closed-it could even stay on his record. However, I still suggest he enter a not guilty plea to the obstruction of justice charge and try to negotiate a better outcome than a conviction. Good luck and please let me know if you have additional questions.

Your husband definitely needs to hire a lawyer any type of charge in relation to Obstruction of Justice. If the officer is accusing him of "bowing up at him" he is probably charged with Felony Obstruction of Justice for "offering to do violence" to the officer (that's the allegation). If I can help, call me at 678-334-1399.

Your husband will have some time before the first court date once he bonds out of jail. Court may not even be this year. Use this time to interview a few different lawyers and hire who you feel most comfortable with handling this obstruction of justice case. Whether your husband has a lasting record of this crime will depend on how things are handled from here out. Obstruction of justice cases can sometimes be resolved with a plea to a lesser charge. It is worth every penny you will pay a lawyer to investigate and defend your husband. I do defend cases in the Gwinnett County Recorder's and State Court. Get your husband an attorney as soon as you can. An obstruction of justice charge is very serious and can have lasting repercussions. Darrell B. As a Gwinnett criminal defense attorney, I can tell you that he absolutely needs an attorney ASAP to try and get this obstruction of justice situation resolved before the case gets too far along. The attorney needs to get a copy of the report and speak with the solicitor who gets assigned to the case to get out in front so you can get the truth out there before the prosecutor decides to fully believe whatever the police officer decides to say. There may be ways to get the arrest cleared and keep a conviction off his record, but you need to act sooner, rather than later. Please let me know if I can be of assistance. I would be happy to help. Regards, M. Jason Rhoades
