If your parents abuse you, but you're a minor, can you let someone else take custody over you?

I am 13 years old. I have been abused for almost all my life. My parent's have had CPS called on them several times. But they do nothing. My friends parents' are willing to sue my parents for custody over me. Their daughter has witnessed me being abused, along with other people. I have been trying so hard to get out of this house. Im scared to death everyday. I haven't been eating & i cant sleep. I really hope i get good news.

Important disclaimer: I am licensed to practice law in Oregon, not Washington, and so I can't give advice on any specific Washington laws. So this is just a discussion of general principles. Minors do not get to decide who has custody of them. However, if you're being subjected to abuse, then you should continue to report it. Talk to a counselor or other official at your school. They're legally required to take certain steps to keep you safe.

You need the help of other adults. You may also need help yourself. It is doubtful that your friend's parents will be able to assist you in the manner that you would like. There are a variety of steps that you can take. I suggest some or all of the following: 1) Talk frankly with a school counselor; contact the local YWCA domestic violence advocate; contact the northwest justice project and ask for an attorney (http://nwjustice.org); visit the juvenile court - at the juvenile facility and ask to speak to a social worker to assist you and see if you qualify for a Child in Need of Services Petition or an At Risk Youth petition. (C.H.I.N.S or At RisK Youth). Seek help and assistance as best you can. You are also allowed to call Child Protective Services. 1-866-363-4276. Good luck.

Yes, your friend's parents can bring a non-parental custody case to help you. The courthouse probably has a lot of resources to help them, but it would be a very, very, very good idea to have them at least get a consultation with an experienced lawyer first. If they do not follow through with this, please do keep seeking help from other responsible adults. I'm sorry that things are so tough for you and hope that you triumph over these hard things and make a good rest of your life for yourself .
