Can someone advise me on what to do when the insurance company says they do not leave medical cases open?

I fell at work, broke the humeral head off my shoulder and had the joint replaced. Surgeon who repaired the arm gave me high marks for rehabbing the arm but 'guaranteed' I will have future problems with the shoulder. He advised me not to settle so future problems could be covered as well. The insurance company said that they do not leave medical cases open that I needed to settle. I have returned to work but not as many hours as prior to the injury. I work enough not to get a weekly disability check but obviously have less income due to the injury also. Please advise. Thank you. (City, State are not my residence but more anonymous than smaller towns)

You should contact a Kansas workers compensation lawyer as soon as possible. Your question does not indicate when your accident happened, but it is important to realize there are strict deadlines for filing claims. There are situations in Kansas workers compensation where your future medical treatment will be covered even after a trial of your claim, but there is not enough information above to evaluate whether that will be likely for you. It is important that you get legal help sooner rather than later so you do not lose any of your rights under the law.

I hope you are not relying on the Worker's Compensation insurance carrier to give you sound legal advice. The sole goal of any insurance carrier is to pay you nothing or as little as possible on your claim. They are neither your good neighbor nor your friend. You would be in better hands with an alligator. You need to contact a well-qualified Worker's Compensation attorney to protect your rights, including your right to future medical care. I suggest you have no further discussions with the carrier and have this problem addressed by your worker's compensation attorney.
