California Superior Court ---- So if the pipe burst on its own without any negligence on the part of the occupant is there no claim?

I am not sure exactly what you are asking. A broken pipe may be covered under one or more insurance policies. Submit a claim to your insurance, the neighbors, and the hoa's and let the insurers fight over who is responsible.
