My boyfriends daughter and husband were both arrested for child endangerment and child neglect. Her husband is a felon

He was also charged with gang enhancement, felon in possession of a firearm, in possession of illegal ammo, possession of metal knuckles, and making threats. If any of these charges are a "strike" this would be his third. What kind of sentence could he possibly be looking at? She has no prior record other then a few traffic violations. Will they both be looking at Prison time?

This is a criminal law question. I suggest that you re-post in the criminal law section. I will also change to a criminal law practice area so you get more meaningful responses.

When you say "making threats," I assume you are referencing Penal Code section 422 (criminal threats), which is a strike offense. The other charges you mentioned would not trigger the third strike consequences, unless the gang enhancement is sustained, in which case the associated felony would also trigger third strike consequences. If convicted of PC 422 or another felony with the gang enhancement he would be looking at 25 - Life for each such charge.

To add to Ms. Myers' answer: the daughter may/may not be looking at prison time depending upon the extent of the endangerment and neglect. Often times the endangerment has to do with the environment in with the child is raised or the situation in which the child is put in (like a passenger in car being driven by drunk driver). I am GUESSING that if the father is going to prison, the court will try to reunify the daughter with her children. She may not get jail time but it could be worse: she could lose custody of the children, temporarily [which often leads to permanently]. She will have to undergo parenting, drug counseling (if applicable), drug testing, etc etc. in an effort to correct the problems with her parenting.
