What are the child visitation rights for a person on house arrest?

My ex recently was released from jail and is continuing the sentence on house arrest. He is requesting to resume the visitation schedule while on house arrest. Our child did not have communication with him while he was in jail and he did not maintain the visitation schedule before going to jail. He is very apprehensive about visits with his Dad who has a history of mental illness which the court has addressed in regard to the DUIs but ignores that there is a child who is effected.

This is more of a family law question. If you don't want the father to have visitation, you need to go back in front of a judge to have the plan modified.

It is time to take your divorce decree and the parenting plan to a family law attorney and get advice from an attorney that is fully informed about the background of the case.

You will need to hire an attorney to properly present the case for not allowing visitations. If a plan is currently in place, you may always move the Court to modify.
