Re: Can my employer deduction rent from my paycheck... I work for a motel owner and rent a room.

I pay faithfully with very few times getting behind and always pay when I say I will. This room agreement has nothing to do with conditions of my employment. One time they deducted $60 (as an advance) toward my rent, when in fact I only owed $40 at the time I got my paycheck and I had told his bookkeeper I would pay the past due when I got my check. Another time $10.87 was deducted for rent past due (as accounts receivable) also after I said I would pay when I got my check. Both times I did not agree to have these deductions and both times I would not even have been more than 2 days in arrears for my rent due. Thank you so much for reading and responding.

No, it's not legal. These are 2 separate business arrangements and must be documented as so. The check stub should state the full about of your pay and the rents should be documented as rent receipts. Certainly you could and should tell your employer but it's likely to interfere with either your job or your living arrangement or both. If you aren't being paid your full wages, you could file a complaint with the department of labor. Good luck!

Atty Kazouris is right. You have to consider the practical effect against the legal effect.
