Tenant accusing maintenance crew of stealing.

Landlord Tenant Law 4 views 2 answers
The tenant has lived in the unit for 3 months. I sent maintenance crew to replace baseboards that were damaged when the tenant flooded their upstairs unit and two other units by breaking off the fire sprinkler in bedroom ceiling. After the repairs the tenant called said he was missing a flash drive that he left on the television. The crew has worked for me for 1 1/2 years. I haven't had any complaints even when the tenant allows the crew in when they are not home. What suggestions do you have to handle this situation?

Many times people unknowingly lose items; whether by forgetting that they moved it from the TV or it could have fallen and is not in view, etc. This is a common issue with maid services (accusations of theft). Lawsuits require proof of the alleged wrongdoing and the resulting damage. Credibility of the witnesses and the parties are also part of the factors for a case. It's always possible the tenant will find the item in an obscure location and drop it. Otherwise, issuing a denial with the facts is something you can do. If the tenant brings a lawsuit, go to trial with witnesses of your worker's 1.5 yrs of entering apartments with no complaints and other proof of his/her trustworthiness. The tenant will have to prove their claim. Get an attorney if there is a lawsuit though.
