Should I take part in Hall VS Bank Of America?

Class Action 3 views 3 answers
Have been sent claim form. I have been working with NACA, to get them to modify my home loan for over four years now. We all know the story behind this so I won't go into details only to say, its a mess. However, I was mailed the Hall vs Bank Of America form. It looks legit but I don't want to part in it if it is going to relieve them of any other responsibilities in my home loan. Is it a trick?

The class action "Release" would indicate what rights the class members are giving up. This should be made available on the settlement website (the settlement website is probably indicated on the claim form) and be part of the Settlement Agreement. You may want to contact Class Counsel in the action regarding such question so that they can explain the scope of the release to you.

Class action settlements often provide class members with decent outcomes, particularly where you don't want to have to do anything beyond filling out a claim form. But many settlements discount the claims due to the uncertainty of class certification, or because of the plaintiffs' lawyers unwillingness to risk (or finance) further litigation. So, if you can and are willing to hire a lawyer and prosecute your own individual case, a better deal is often possible. But remember: That depends on the value of your claim, and whether you have the right to recover individual attorneys fees. If you have a meaningful sized claim, and a right to individual attorneys' fees, then "opting out" (requesting to be excluded) from the class may make good sense. But only if you'll be bringing your own claim. Happy to answer further questions, as I realize this is a lot of information.
