In California, are there any specific licensing requirements to start Brainwave Entrainment Company?

I am a part/time (certified) hypnotherapist. I make extensive use of brainwave technology software to design pleasant and effective audio sessions for friends and family members. The programs I use are easily available on the web and any one can download and use it. Since I have hypnotherapist education, I strongly feel I can make a good use of technology tools and positively impact the life of others. However, at the same time I want to make sure my good intentions don't backfire me in anyway. I had no problem in obtaining city and county business license, but I am unable to find any resource in California, that stops me from doing what I wish to do. I am not planning to be a psychiatrist/psychologist or behavior counselor etc. It is more about stimulating brain to get positive results.

You have asked this exact question before. None of us has any experience with this technology. You do. I suggested you inquire of trade organizations you belong to. I reiterate that advice.

I concur with Attorney Straus. You currently have both city and county business licenses per the facts you have given us. Were you given those licenses knowingly by the agencies granting them and specifically knowing the approach that you were taking with this technology?

Of you are just lighting candles and playing noise to make them feel better, I don't believe that rises to the level of practicing without a license.

People in California who perform hypnotic techniques on others for a fee must comply with, at least, California Business and Professions Code sections 2908 and, perhaps, 2053.6 [visit the links below]. You need to speak with an attorney who specializes in health care law. Good luck.
