Can I get out of a townhouse lease if the landlord never got a C/O?

The landlord never got a fire inspection or certificate of occupancy and when the township found out, they sent an inspector out and gave a list of issues that needed to be resolved It has been 45 days and everything still has not been fixed. Can I get out of my lease since I should not be living there legally?

If he is working to fix the issues it would not be certain that you succeed. Especially if he has achieved the CO

There are some provisions in the landlord tenant law regarding "illegal tenancies." I agree with my colleagues that this circumstances may not constitute an illegal lawsuit, but the fact that there is no fire certificate of certificate of occupancy, the township may consider it an illegal tenancy. You should consult with a local attorney. If it is an illegal tenancy, a landlord may be obligated to reimburse some rent and/or pay your moving expenses.
