Can I sue a home inspector for missing major problems that will have cost us $40,000 in repairs for pre-existing conditions?

Its been 1 1/2 years since purchase of the home. Since moving in we have had to deal with a major mouse/rat infestion that had been going on for years prior to the purchase of the home. Found 13 dead mice in the drop ceiling in the basement, found live mice in the house. Paid money for Orkin, had all vents & furnace cleaned several times, had basement cleaned professionally. Home Inspector told us we had a dry basement - basement needs all new drain tile - it is a very wet basement with mold. He missed that. Told us the foundation was great and that we would have no issues with it. The basement wall has a horizontal crack that will require a $15,000 job to fix because the wall is going to cave in. Do we have a case to sue?

Subject to a thorough review of all relevant documents, including the home inspection agreement, you may have grounds to sue the home inspector. If you have not already done so, send a letter, return receipt requested, to the inspector detailing the issues and associated costs. You may also want to consult with a real estate attorney to determine the best course of action.
