You are very brave to take on a big bank, but to do so requires going about it the right way. There is really no civil cause of action known simply as "harassment". When most people use the word "harassment," they simply mean that another person or entity is really annoying them. There is no constitutional right not to be annoyed; although if a bank is using collection techniques that are barred by law, they might have to pay damages. Virginia's Consumer Protection Act specifically excludes banks and insurance companies from its protections (Why? Mostly because they have the money and power to legally bribe our elected officials with campaign donations - but that's another story). Federal banking law preempts a great deal of state law, and you might actually have to be in Federal court, rather than state court, to pursue anything you have that is legally worthwhile. And you can easily get stuck with the other side's court costs if you don't prevail in Federal court. By no means should you attempt to do this without a lawyer; and unfortunately, a lawyer can get in ethical trouble if he drafts pleadings for a person who claims to be in court representing themselves (alternatively, he could actually be forced to represent you in court without being paid). So you may simply be stuck with hiring an attorney, or getting nowhere with your case.
