girlfriend of 6 years has had 3 c sections with scarring of the uterus and complications almost near death so the next c section will have risk. she got pregnant after a year from the laproscopic tubal litigation surgery pregnancy seems to have occured naturally not ectopic. attorneys rarely take a case of this nature unless its a slam dunk because of injury and the hefty investmet costs of medical experts and jurys are opinionated to the idea that there is no burden or pain and suffering just another greedy lawsuit so what would win this case or bring a settlement. she has elected to have her uterus removed n during the c section if possible to ensure no more pregnancies i know she needs an invasive surgery to.investigate the tubal litgation what can we do besides give up

Your facts are not really clear so it is difficult to comment about the strength of her claim. It sounds like you have spoken to some attorneys already. If you are saying that she had a tubal ligation to prevent pregnancies and then had all of these problems, there might be a valid claim there, but you need to be clearer.

Lawyers don't usually take cases like this because in most states, an unwanted pregnancy following an intended sterilization is not a basis for a medical malpractice claim. Your girlfriend should ask a medical malpractice lawyer in your state if this is the law there.

My colleagues give good advice. Keep in mind there's a big difference between unwanted occurrences and malpractice. Medical science isn't perfect. The unintended consequences of a pregnancy might actually be a known risk to the medical procedures your girlfriend has had.

Iowa does not recognize a cause of action for "wrongful life" (i.e., an unwanted pregnancy).
