Does Code 40-6-20 include turning when the sign says not to turn during certain hours? Is that the correct code?

My husband got a ticket, code 40-6-20, for turning down a road that you're not supposed to turn on between 7-9AM in Sandy Springs, GA. He knows he's guilty and we were going to pay the ticket on-line, but the info didn't come up with the citation #, had to look it up by his name. And it said "running red light"... that's not what he did or what's written on the ticket. Does turning right when sign says not to during certain hours come under the same code as 40-6-20 or did the police officer write down the wrong code?

As silly as it sounds, 40-6-20 is the code for failure to obey a traffic device, which according to statute includes lights as well as traffic signs like the one you described.

40-6-20 is fialure to obey a traffic control device. It can be a sign or light. If he goes to court and pleads nolo the offense will not carry any points. Points only matter when you accumulate 15 in 24 months, which results in a license suspension. I think that offense carries 3 pts. Everyone's situation is different. Good Luck!

Do a Defensive Driving course before court, show the certificate to the Solicitor and ask them to amend the charge to a Basic Rule which is not reported for GA drivers.

Yes. 40-6-20 is the code section for Failure To Obey A Traffic control Device, and it sounds like this is what your husband did. If your case is in The Municipal Court of Atlanta I would go to court on my court date, and participate in their pre-trial diversion program. This will result in your husband's ticket being dismissed, and it will not go on his driving history. Otherwise, I'd ask the prosecutor to reduce the charge to a non-reporting violation so the charge will not go on his driving history.
